Settlement in PGC2 v Abbotts

According to attorneys for both parties, there has been a settlement in at least one of the cases involving Derek and Rebecca Abbott and PGC2 LLC, the corporation that owns the Boothbay Harbor Country Club.

Few details were immediately available, but Sumner Lipman, the Abbotts’ attorney, and David Soley, attorney for PGC2 LLC and its principal Paul Coulombe, said the case was settled to the parties’ satisfaction.

The country club was accused of encroaching on the rights-of-way that allow the Abbotts access to their property, a horse farm abutting the 14th tee of the golf course. The golf course erected an eight-foot-tall fence, which the Abbotts called a “spite fence.” The Abbotts responded by bringing their horses onto the right-of-way, and temporary restraining orders were requested by both sides. Both sides were ordered to keep themselves on their own property in advance of a mediation meeting on Aug. 17 and a court hearing on Aug. 23.

The Aug. 23 hearing was canceled after the settlement was reached.
