Former inmate’s suit settled
The case brought against Two Bridges Regional Jail by a former inmate will not be moving forward.
The lawsuit brought forth by Amanda Hayes against Administrator Mark Westrum, Lt. Richard Thompson, former guard Brian Bossie and the jail has been settled, Jail Attorney Peter Marchesi said.
Last week, the two sides were able to reach an agreement after a judge in district court ruled in favor of the defendants.
In addition, Hayes will not have to pay for fees incurred by Westrum, or the jail, associated with the lawsuit. She had been seeking an award of compensation, punitive damages and relief from lawyer fees.
Hayes' suit alleged that Bossie, who worked as a corrections officer at the jail, groped and sexually harassed her in September 2011 while she was serving eight months for a probation violation after a theft conviction, and that the jail knew and condoned the behavior.
In April, 2012 Bossie pleaded guilty to assault as well as unlawful sexual touching in Lincoln County Superior Court.
The plaintiff would have had to prove that not only did a culture of inappropriate behavior flourish at the jail, but that it was widely know amongst the administrators, Marchesi said.
“It was a very difficult case to prove against the jail,” he said. “You'd need to show that not only was this a widespread pattern of behavior, but you'd need to show that (jail administrators) knew about it and did nothing.”
